How do I know which category I fall under?

Invitee. An invitee is a person who is on the property with the approval and consent of the owner or someone who brings economic benefits to the landowner. Examples include a customer of a restaurant, a shopper, a sports fan attending a game, or a moviegoer. Generally, a landowner is responsible for any injuries that are suffered by invitees that are caused by dangers that the property owner knew or should have known existed on the property. Additionally, the property owner has an obligation to provide a safe environment by repairing any hazards or warning or their existence.

Licensee. A licensee is someone who comes onto the property solely for their own convenience without invitation either expressed or reasonably implied under the circumstances. An example of this would be a salesman who enters a business uninvited. Generally, the landowner’s duty to licensees is to refrain from willful misconduct or wanton negligence, to warn of known dangers not open to ordinary observation, and to refrain from intentionally exposing the uninvited licensee to danger.

Trespasser. A trespasser is a person who enters the property without permission from the landowner. Generally, the landowner is only responsible to protect trespassers from highly dangerous artificial conditions actually known to the landowner.
